Knives Out Hamper Competition Terms & Conditions

1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents.

3. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.

4. Employees (and their immediate families) of the Maggie Beer Products are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

5. Promotion commences 12pm AEDT Thursday 14th November 2019 and closes at 9am AEDT Monday 18th November 2019. (“Promotional Period”).

6. To enter, individuals must purchase a Maggie Beer Hamper during the “Promotional Period” of between Thursday 14th November at 12pm AEDT and Monday 18th November 18th 9am AEDT. This will qualify as an automatic entry to the competition.

7. Incomplete or indecipherable entries will be deemed invalid.

8. Multiple entries are permitted, upon multiple purchases.

9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

11. There will be five (5) draws conducted for the entries received during the Promotional Period.

12. All draws will take place at 2 Keith Street Tanunda, SA, 5352, on Tuesday 19th November at 9:30am AEDT.

13. Winners will be notified in writing by email within two (2) business days of the draw, and the winner’s name will be published online at www.maggiebeer.com.au on 20/11/2019 for 28 days.

14. The Promoter’s decision is final and no correspondence will be entered into.

16. The first ten valid entries drawn will win the major prize. The major prize are two double passes to Studio Canal’s film Knives Out. Tickets are valid from Thursday November 28th at participating cinemas until season completion. Prize winners will receive one ticket, with each ticket valid for two patrons and for one free session of Knives Out.

a) Tickets are valid even with “No Free Tickets” restriction. Not valid on cinema discount days, Saturdays after 5pm or Public Holidays. Not valid with any other offer. 17. Any expenses or costs incurred by the winner, not specifically including in the definition of prize, will be the winners’ responsibility.

18. If a winner is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian on the winner’s behalf.

19. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited.

20. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

21. Total prize pool value is $300.00 including GST.

22. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

23. A draw for any unclaimed prizes may take place 2/12/2019 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing by email within two (2) business days of the draw.

24. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

25. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

26. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

27. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the Competition and Consumer Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

29. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking and/or use of a prize.

31. All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter to conduct this competition including to conduct the competition draw and to notify any winners. If the entrant does not provide the information required in the entry form, they will not be eligible to win the competition. Entrants will also be given the option of opting in to receive future promotional material from the Promoter. Entrants may opt-out of direct marketing at any time. The Promoter may disclose entrants’ personal information to its contractors, agents, service providers, prize suppliers and, as required, to Australian regulatory authorities to assist in conducting this competition or communicating with entrants. Maggie Beer Cookbook Signing Terms & Conditions

  1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

  6. To enter, individuals must complete the following steps during the Promotional Period:

a) Purchase one of the marked “Maggie To Sign” cookbooks applicable to the Maggie’s Verjuice Cookbook and Maggie’s Recipe for Life Cookbooks.

b) Offer is only valid for one hundred (100) cookbooks, fifty (50) Maggie’s Recipe For Life and fifity (50) Maggie’s Verjuice Cookbooks.

c) Customer must check the box "This order is a gift" and enter the name of the person you would like Maggie to sign the book to in the "Gift Details" section when in Billing & Delivery (2nd section before payment)

d) Due to time constraints personal messages cannot be included

When you enter our competitions we collect the personal information you provide. If you win one of our competitions we may collect further information from you. We may also be required by gaming and lottery legislation to collect some of your personal information.

If we do not collect some or all of this information, we may not be able to enter you into the competition or provide the prize.

We collect this information to enable us to administer the competition and fulfil the prize, and promote and market products and services of ours and our partners.
